A part of the BOYKOT DANMARK campaign was a poster with a pixilated image of the Little Mermaid, taken by the initiator of the campaign, on a red and white chequered background. In late August last year, BOYKOT DANMARK was contacted by the lawyer firm Norsker & Jacoby on behalf of Edvard Eriksen Arvinger I/S for violating the copyrights of the sculptor of the Little Mermaid, which belong to the inheritors of Edvard Eriksen (1876-1959).
At the time it was not to our knowledge that the Little Mermaid was protected by copyrights, some 40 years after the death of the sculptor. Since the sculpture is a national property and a worldwide known symbol of Denmark, it did not occur to us that taking a photo and using it would violate any copyrights. But the inheritors of Edvard Eriksen possess the artistic rights to all imagery of the Little Mermaid, and seem to be able to censor the freedom of expression of other individuals.
The copyright owners demanded DKK 50.000,- for violating the artistic property. A polite apology and explanation about the non-profit campaign did not change this demand. After several correspondences between lawyers, an agreement to pay a penalty of DKK 5.000,- was finally settled, after documenting the economy of the initiator of the campaign. Since August the campaign has been sleeping but does not seem less relevant today than it did back then...
